Terms and conditions of sale

1. Definitions
1.1 The “Buyer” means the person who buys or agrees to buy goods from the Seller.
1.2 The “Seller” means Labels Most Wanted.
1.3 “Conditions” means the Conditions of sale set out in this document and any special conditions agreed in writing by the Seller.
1.4 The ‘Sender’ means the person sending the goods to the Seller
2. Conditions
2.1 These “Terms and Conditions” do not affect your statutory rights as a consumer.
2.2 All contracts of sale made by the Seller shall be deemed to incorporate these terms and conditions which shall prevail over any other document or communication from the Buyer.
2.3 If any amendments to these terms and conditions are required, they should be confirmed in writing.
2.4 Acceptance of delivery of goods shall be deemed conclusive evidence of the Buyers acceptance of these Conditions.
3. Prices
3.1 The price shall be that on the final invoice.
3.2 All prices are exclusive of charges for packing, postage and carriage unless otherwise stated and which shall be paid in addition, and displayed on the Buyer’s invoice.
3.3 The total purchase price, including delivery charges will be displayed in the Buyer’s invoice.
3.4 Payment must be made in full before dispatch of any goods.
3.5 Payment is due in full no more than 2 days from the date of invoice. Time for payment shall be of the essence and any failure to pay shall entitle the Seller, at its option, to treat the contract as repudiated by the Buyer.
3.6 If any act or proceedings shall be commenced in which the Buyer’s solvency is concerned, all monies under any transaction covered by these Conditions shall become immediately due and payable.
3.7 A payment plan (also known as layaway/installment) may be agreed with a buyer on an individual basis. Terms will be a agreed and a deposit taken, with the balance being due by a specified date. An agreed proportion of that deposit will be non-refundable should the buyer cancel the order at any time, not make the final payment by the due date or return the order.

4. Warranty and Liability
4.1 All items are sold ‘as is’ and therefore no warranty is given or implied. Items sold with original purchase receipt may be within manufacturer’s warranty, but it is the buyer’s responsibility to confirm any warranty period prior to contract and that warranty remains with the manufacturer
4.2 While every effort is made to ensure that the product descriptions are accurate, the nature of the goods may lend to personal interpretation.

5. Delivery
5.1 Goods will usually be dispatched within 2 working days from cleared payment being received unless notification is provided otherwise.
5.2 Where a specific delivery date has been agreed, and if this delivery date cannot be met, the Buyer will be given the option to agree a new delivery date.
5.3 Whilst every reasonable effort shall be made to keep any delivery date, time of delivery shall not be of the essence and the Seller shall not be liable for any expenses incurred by the Buyer or any other person or Company arising directly or indirectly out of any failure to meet any estimated delivery date.
5.4 Delivery of the goods shall be made to the Buyer’s physical address, not a PO Box in the case of courier deliveries, and the Buyer shall make all arrangements necessary to take delivery of the goods whenever they are tendered for delivery.
5.5 A tracking number will be provided for each item sent and will be insured accordingly
5.6 In the event of the non receipt of an item, the Buyer should inform the Seller of the non-delivery within 7 working days for UK buyers, and 15 working days for international buyers, from the Seller despatching the item. After 15 working days for UK buyers, 20 working days for European buyers and 25 working days for other international buyers, if the item has still failed to arrive, and the tracking does not indicate its arrival, the Seller will refund the buyer in full.
5.7 In the event of an item being returned to the Seller due to attempted deliveries being unsuccessful, the Buyer will receive the option of a refund of the original sale price (excluding the original postage price paid), or if re-delivery is required, the Buyer will be responsible for the cost of the re-delivery, before the item is dispatched again.
5.8 Collections are not accepted by the Seller unless specifically agreed beforehand.
6. Customs
All items sent outside the EU will have the customs/declared value stated as your final purchase amount. Buyers are responsible for any customs duty or charges which may be due. Buyers should be aware of their country’s import duty prior your purchase. Items returned due to customs fees not being paid, will be refunded for the purchase price but not the original outgoing shipping charge.
7. Ownership and Risk
7.1 The risk in goods shall pass to the Buyer upon delivery of the goods.
7.2 The Seller remains the owner of the goods affected by the contract until the Seller has been paid in full for such goods.
7.3 The Buyer shall inspect the goods immediately upon receipt and shall notify the Seller within 48 hours of receipt if the goods are damaged. If the Buyer fails to do this he is deemed to have accepted the goods.
7.4 Any Goods in respect of which any claim of defect or damage is made shall be preserved by the Buyer intact together with the original packing at the Buyer’s risk and either a) return the goods to the Seller for inspection and, if appropriate, a refund. b) Return the goods to the Seller for inspection and, if appropriate, a replacement.
8. Cancellation and Returns
8.1 If it is agreed that the goods are to be returned: a) the Buyer must notify the Seller that the goods are to be returned prior to the goods being sent. The goods must be returned by a trackable method, with the tracking number provided to the Seller. b) The Buyer will be liable for the cost of return shipping and of remedying any damage to the Goods returned where such damage has, in the opinion of the Seller, been caused by the goods being inadequately packaged by the Buyer or through the Buyer’s fault.
8.2 If you are a consumer you have the right, in addition to your other rights, to cancel your contract with Labels Most Wanted and receive a refund. You must contact the Seller in writing to cancel your contract within 48 hours of receipt of the goods. Once you have received confirmation that your return has been agreed, you must return the goods in their original condition and with all associated packaging, at your cost, within 14 calendar days after the date of their receipt. The goods must then be received by the Seller without undue delay and in any case not later than 14 calendar days after the Buyer has notified the Seller of their intention to return the item. After this time period, returns will not be accepted.
8.3 Returns from non-EU countries must clearly state ‘Returned Merchandise’ on the customs documentation.
8.4 Upon receipt of the returned item and upon successful inspection of the item, the Seller will refund the Buyer by the same method that the original payment was made and including any outbound postage cost. Should the item be returned due to it being defective or damaged, basic return postage (the least expensive postage option) will be refunded by the Seller. Any Customs costs incurred by the Seller to receive the item will also be deducted from the refund provided. The refund will be processed within 48 hours of item receipt.
8.5 It is agreed that the Seller can cancel the contract with the Buyer, and issue a full refund at any time, until the goods are despatched. The purchase of the goods is an invitation to purchase only.
9. Commission Selling Service
9.1 The commission service offered is at the discretion of Labels Most Wanted. No assurance is given that an item accepted for sale will sell at the price proposed, at a reduced price, or at all.
9.2 Initial resale prices proposed are on the basis of full disclosure of the items condition, and accompaniments
9.3 Email acceptance of the proposed resale price constitutes a sole marketing agreement with Labels Most Wanted until otherwise agreed in writing
9.4 The item should be sent to Labels Most Wanted within 7 calendar days of email acceptance, securely boxed and via an insured, trackable postal method
9.5 By sending an item to Labels Most Wanted the Sender is confirming that; a) They are the rightful owner of the item and/or if the item is being sold on another’s behalf the Sender has the owner’s permission to sell as if their own b) The item is not stolen or under hire/subject to any financial agreement c) The item may be lawfully sold to consumers without restriction d) The item is as described
9.6 If the item’s condition on receipt varies from expected, then Labels Most Wanted reserves the right to amend the proposed resale price appropriately. If the proposed resale price is not acceptable to the Sender then the item will be returned to the Sender by fully insured, trackable post. The cost of return postage must be borne by the Sender prior to return. Labels Most Wanted will not be liable for any return postage costs, customs costs nor other costs incurred.
9.6b If an item received is deemed to be non-authentic, it will be returned to the Sender at the Sender’s cost, upon receipt of shipping payment, a £10 (ten UK pounds) administration fee and authentication fee from the Sender. Counterfeit items will be held for a maximum period of up to 180 days, and if return payment is not received within this time, the item will be disposed of.
9.7 If an email response is not received from the Sender within 7 calendar days of confirmation of resale price, then Labels Most Wanted assumes acceptance of contract and will proceed to market the item as per agreement
9.8 Items may be returned to the Sender at any time, at the discretion of Labels Most Wanted. If the return is instigated by Labels Most Wanted then the cost will be borne by Labels Most Wanted.
9.9 When a sale is achieved and the item released to the Buyer, the funds are held by Labels Most Wanted in escrow for a period of 14 calendar days from the day after the Buyer has received the item (excluding public holiday), awaiting the Buyers confirmation of safe receipt and satisfaction, and to comply with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (formerly known as Distance Selling Regulations) return policy timescale
9.10 The Sender will be notified as to a successful sale at the end of the 14 day period and funds transferred to their nominated bank account within 24 hours. The Sender will receive from Labels Most Wanted, a breakdown of the transaction and associated fees
9.11 Labels Most Wanted will retain 25% of the final sale price for its services (which excludes international postage), and includes all deductions, being their commission fee, postage, paypal fees and ebay fees, where applicable. The minimum fee will be £10 and the maximum £750.
9.12 Whilst the item remains the property of the Sender until the Buyer accepts ownership, any photographic images or text created by Labels Most Wanted in relation to the item, remains the Sole property of Labels Most Wanted and cannot be assigned, reproduced or recreated for any commercial purpose.
10. Outright purchase service
Items for which an outright purchase agreement is made by Labels Most Wanted must be accurately described, and any offer will be based on that description, including any photographs provided by the Sender. Once an outright purchase agreement has been made, the item should be sent to Labels Most Wanted by a trackable method and the tracking number supplied. Upon receipt of the item, if it matches the description provided by the Sender, payment will be made within 24 hours of its receipt by the agreed method to the Sender. If the description does not match that provided by the Sender, an appropriate deduction will be agreed, or the item may be returned to the Sender at the Sender’s cost, for which payment will be required beforehand. If the item received is deemed as counterfeit, it will be returned to the Sender at the Sender’s cost, for which shipping payment and a £10 (ten UK pounds) administration fee will be required beforehand. Counterfeit items will be held for a maximum period of up to 180 days, and if return payment is not received within this time, the item will be disposed of.
11. Force Majeure
In the event that the Seller is prevented from carrying out its obligations under a contract for sale as a result of any cause beyond its control such as, but not limited to, Acts of God, War, Strikes, Lock-outs, Flood and Failure of third parties to deliver goods, the Seller shall be relieved of its obligations and liabilities under such contract for sale for as long as such fulfilment is prevented.
12. No Waiver
12.1 The Seller’s failure to insist upon strict performance of any provision of these Conditions shall not be deemed to be a waiver of its rights or remedies in respect of any present or future default of the Buyer in performance or compliance with any of these conditions.
13. Liability
13.1 Except as may be implied by law where the Buyer is dealing as a consumer, in the event of any breach of these Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential damage.
14. Miscellaneous
14.1 Any contracts shall in all respects be construed and operate as an English contract and in conformity with English law.
14.2 If any part of these terms and conditions that is not fundamental is found to be illegal or unenforceable, such finding will not affect the validity or enforceability of the remainder of these terms and conditions.
15. Copyright
You may download, display, print, post and reproduce material from Labels Most Wanted in unaltered form only (retaining this notice) for your personal and non-commercial use, (eg; information sharing, opinion gathering and authentication requests). Reproduction of material for commercial use is not-permitted, eg copyright material may not be used on sites such as eBay or similar
16. Data Protection
16.1 All information collected by Labels Most Wanted is the sole property of such. This information will not be shared or sold. Information retained will only be your name, address, email, phone number and the items purchased.
16.2 All credit/debit card payments are made privately and securely via PayPal. No financial information is held on this site
